What this website collects

This website does not use analytics, advertising pixels, tag managers, session recording, social media embeds or any other third-party tracking. No cookies are set for tracking purposes.

There is one point at which this website collects personal information: the enquiry form on the contact page. If you do not use that form, this website collects no personal information about you beyond the technical records described below.

  • Enquiry form: your name, email address, telephone number (optional), the type of matter you select, and the message you write.
  • Technical records: our hosting provider keeps standard server logs, which may include your IP address, browser type and the pages requested. These are generated by the hosting infrastructure, are used for security and troubleshooting, and are not linked by us to any individual.

Why we collect it, and on what basis

We use the information you submit through the enquiry form for one purpose: to respond to your enquiry and, if you become a client, to act in your matter.

The lawful basis is your consent, which you give by ticking the consent box and submitting the form. Supplying the information is entirely voluntary. If you do not supply it, we simply cannot answer your enquiry — there is no other consequence.

We do not use your information for marketing, we do not add you to a mailing list, and we do not profile you.

A specific caution about this website

A person visiting a criminal defence website may be facing prosecution. We regard that as sensitive, and it is the reason this site carries no third-party tracking of any kind — we are not willing to have your visit here shared with an advertising network.

Please also note that an email or form submission is not a privileged communication. Legal professional privilege attaches to communications with your attorney once an attorney–client relationship exists. Until we have spoken and accepted your instruction, do not send us details of a live matter that you would not want read by anyone else. If the matter is urgent or sensitive, telephone us instead.

Who we share it with

Enquiries submitted through this website are delivered to the firm by email and are read by the directors and staff of Jay Inc who need to see them.

We do not sell, rent or trade personal information. We do not share it with marketing partners. We may disclose information where the law requires it, or where it is necessary to act in your matter — for example to counsel, to a court, or to another party in litigation, all of which would be with your knowledge as our client.

Where it is stored, and for how long

The enquiry form does not store your message on this website or in any database. It composes an email and sends it to the firm. The record of your enquiry is the email in the firm’s mailbox.

Enquiries that do not become matters are retained for a limited period and then deleted. Where an enquiry becomes a matter, the file is retained in accordance with the firm’s professional obligations and the periods prescribed for attorneys’ records, which are longer.

VERIFY — the firm should state its actual retention period for unconverted enquiries here.

Cross-border transfer

Email and hosting services may involve servers outside South Africa. Where personal information is transferred outside the Republic, POPIA requires that it be subject to comparable protection. VERIFY — the firm should confirm where its email is hosted and name the position here.

Security

This website is served over an encrypted connection (HTTPS). The enquiry form submits directly to the firm’s own hosting and does not pass through a third-party form service.

No system is perfectly secure, and email in particular is not a secure channel. That is why we ask you not to send sensitive detail before we have spoken.

Your rights

Under POPIA you have the right to:

  • Ask what personal information we hold about you, and request a copy of it.
  • Ask us to correct information that is inaccurate, irrelevant, excessive, out of date, incomplete, misleading or unlawfully obtained.
  • Ask us to delete or destroy information we are no longer entitled to keep.
  • Object to our processing of your information.
  • Withdraw your consent at any time, which will not affect processing that took place before you withdrew it.
  • Complain to the Information Regulator.

How to exercise a right, or complain

Write to the Information Officer at peterjay@jayattorneys.com, or to the postal address above. We will respond as soon as reasonably possible.
